1. Acceptance of Terms
Welcome to CalmLink VPN (referred to as "the Service" or "we"). By using the Service, you acknowledge that you have read, understood, and agree to be bound by all of the terms and conditions of these Terms of Service (referred to as "the Terms"). If you do not agree to these Terms, please do not use the Service.
2. Description of the Service
The Service provides you with secure, encrypted virtual private network (VPN) connections, including:
- Encrypted connections through servers in multiple countries or regions to protect your data while using public networks;
- A server catalog service: provides public metadata about servers (server identifier, country, city, plan tier, and speed-test endpoints) to the app. It contains publicly available information only and no private credentials;
- Connection latency measurement and automatic selection of available servers for a smoother experience.
3. Eligibility and Account Responsibility
- You must be of legal adult age in your jurisdiction to use the Service;
- You are responsible for ensuring your use of the Service complies with the laws of your country or region;
- You are responsible for all activity carried out through the Service and for keeping your device and account information safe.
4. Prohibited Conduct
When using the Service, you must not:
- Use the Service for any unlawful activity, including but not limited to spreading malware, conducting network attacks, or infringing on the rights of others;
- Interfere with, disrupt, or attempt to bypass any security measures, access controls, or technical protections of the Service;
- Abuse network bandwidth or place an undue burden on the Service, including but not limited to malicious concurrent connections or automated scraping of the server catalog;
- Reverse engineer, decompile, or attempt to derive the source code of the Service or its components;
- Resell, rent, or distribute access to the Service without authorization.
We reserve the right to suspend or terminate your access to the Service upon discovering any of the above conduct, and to take legal action as appropriate.
5. Subscriptions and Payments
Paid features of the Service (such as the Pro plan) are offered through in-app purchases. Subscriptions and purchase restoration are handled by RevenueCat, and payment transactions are completed by the app store you use (such as Google Play or the App Store).
- Subscriptions are auto-renewing. Unless you cancel at least 24 hours before the end of the current period in your app store account settings, the subscription will renew automatically;
- Refunds are governed by the policies and procedures of the app store. We do not process payment refunds directly;
- If the app store changes its subscription policies, the latest rules of the store prevail.
6. Disclaimer of Warranties
- The Service is provided on an "as is" and "as available" basis. We strive to keep the Service stable and secure but do not warrant that the Service will be uninterrupted or error-free, and make no express or implied warranties regarding connection speed, availability, or accuracy;
- VPN services are intended to improve the security and privacy of your network connection, but we are not responsible for the security, content, or conduct of any third-party websites or services;
- To the maximum extent permitted by law, we are not liable for any direct or indirect loss arising from your use of the Service (including but not limited to data loss or business interruption).
7. Intellectual Property
The software, interface, logos, and text content related to the Service are owned by us or the respective rights holders. Without prior written permission, you may not copy, modify, distribute, or use them commercially in any form.
8. Changes to These Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with an updated effective date. Your continued use of the Service after the Terms are updated constitutes acceptance of the updated Terms. We will notify you of material changes through in-app notices or similar means.
9. Changes to and Termination of the Service
We reserve the right to modify, suspend, or terminate the Service (or any part of it) at any time without prior notice. If you violate these Terms, we have the right to terminate your access to the Service immediately.
10. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the People's Republic of China. Any dispute arising from these Terms shall first be resolved through friendly negotiation; if negotiation fails, the dispute shall be submitted to a competent court of jurisdiction.
